Question 40System of Government

If the president can no longer serve, who becomes president?

Answers USCIS accepts

  • The Vice President (of the United States)

What does this answer mean?

If the president can no longer serve, the vice president becomes president. The 25th Amendment, ratified in 1967, says this directly: if the president is removed from office, dies, or resigns, the vice president becomes president.

The amendment also covers a president who can't do the job for a time, for example during surgery or a serious illness. In that case, the vice president serves as acting president until the president is able to return.

After the vice president, federal law sets a longer order of succession. The Speaker of the House is next in line after the vice president, which is one reason the Speaker's name is also a question on the test.

If the vice president's office becomes empty, the president nominates a new vice president, and both the House and the Senate must confirm that choice.

At the interview, say "the Vice President."

Memory tip

Vice means next: the vice president is next in line.
